Questions we often get

Do my products need CE marking to be sold in France?

If your product falls under a European directive that requires it, which is the case for most physical consumer and industrial products, CE marking is mandatory before any sale in the EU, France included.

Who is responsible for compliance: the manufacturer, the importer or the distributor?

The manufacturer handles the CE marking process, directly or through an authorised representative in the EU. The importer must check that the product complies before placing it on the market. A distributor reselling goods already on the EU market has lighter duties. A manufacturer outside the EU also needs a representative, importer or fulfilment partner established in the EU, named on the product or its packaging.

Should we use a distributor, a commercial agent or our own French company?

A distributor is the fastest way in and needs the least commitment, but you give up control of prices and of the customer relationship. A commercial agent represents you without buying stock, which suits business-to-business and industrial products. Your own French company gives full control and makes sense once volumes justify a local structure.

Do we need a French VAT number to sell in France?

A company based abroad generally needs one from its first taxable sale in France. The One-Stop Shop scheme only covers online sales to consumers shipped from another EU country. Once you store goods in France, import into France or sell to French businesses locally, a French VAT number is required.
